As an “Abundant Life Coach” I get asked about the meaning of “financial abundance” very often. What this means to you can be the difference between living the lifestyle of your dreams, or settling for something less than your dreams. I want you to live the life of your dreams!

Here, then, are 5 Essential Factors of Financial Abundance:

“The Abundant Mindset”

Thousands upon thousands of books, articles, media, programs, and so much more have been produced that discuss the awesome power of our minds, and the influence of our thinking upon our lives. It is difficult to say enough or emphasize enough that truth. As I see it, we are exactly as we think.

In my work, I recommend the adoption of an “Abundant” mindset. This means so much more than finance or money, however, for the purposes of this article, I will discuss abundance only as it applies to the world of money and finance.

A financial abundance mindset means enjoying an abundant amount of money, and yet not allowing greed. Greed does not work (sorry, Gordon Gekko). Of course “financial abundance” will be a relative concept; it will probably mean something different to each person. Greed, however, is fairly obvious; it is almost like knowing (within your mid or heart) the difference between right and wrong.

Further, a financial abundance mindset means having the monetary means or resources to enjoy an abundant lifestyle, yet balancing your financial wealth with philanthropy and generous giving (see point 4). When one’s personal motives are clearly defined and one’s goals are aligned with those motives, then financial abundance becomes clear.

“Specialized Knowledge”

The largest difference between the rich and poor (or the “haves” and “have-nots”) is knowledge. Or, more specifically, the largest difference is a specialized knowledge; meaning that they have the “right” knowledge and also know how to use that knowledge to their advantage. In other words, specialized knowledge is the information or data itself, coupled with the wisdom to know how to use the information or data.

For many, specialized knowledge is an academic education such as medical or law school, while for others this might mean computer programming, aviation repair, or something. Further, many of those with a financial education know how to leverage their own money to make more money. Obviously the point is that specialized knowledge translates to earning ability.

“The Power of Compounding Interest and Investing”

For many people, diligent savings and investment of a consistent percentage of income over considerable lengths of time has lead to financial abundance. I would certainly add that economic factors always play a significant role with regard to risk in investments. Even so, living well within one’s means while investing and saving can very often lead to financial abundance.

“Generous Giving”

Generosity does not necessarily mean giving away or donating money. Mr. Zig Ziglar has said: “If you can dream it, then you can achieve it. You will get all you want in life if you help enough other people get what they want.”

This is so very true. It must be an unwritten law of nature that over time, our generosity is paid back several times over. Of course there are exceptions to every rule, and yet employing an attitude of generosity is always a safe bet for a great return. And, if nothing else, it is an illustration of excellence of character.

“What You Love Over Time”

We should seek ways to turn what we love to do into a good living. I am a firm believer that when we do what we love doing, money very often comes as a byproduct, because our focus is not so much on making money as it is on enjoyment and lifestyle. Over time, money tends to take care of itself in large part when we are doing what we enjoy, especially when it helps others.

In conclusion, the very first point – having an abundant mindset – sums up all of the points I have made in this article. When we do what we love to do; when we are generous and seek to help others; when we live within our means and save money; when we always seek a more specialized knowledge…we then have an abundant mindset, and are bound to realize financial abundance.

The 5 components of physical fitness are often used in our school systems, health clubs and fitness centers to gauge how good a shape we are truly in. The 5 components that make up total fitness are:

  • Cardiovascular Endurance

 

  • Muscular Strength

 

  • Muscular endurance

 

  • Flexibility

 

  • Body Composition

Total fitness can be defined by how well the body performs in each one of the components of physical fitness as a whole. It is not enough to be able to bench press your body weight. You also need to determine how well you can handle running a mile etc.

A closer look at the individual components:

Cardiovascular endurance is the ability of the heart and lungs to work together to provide the needed oxygen and fuel to the body during sustained workloads. Examples would be jogging, cycling and swimming. The Cooper Run is used most often to test cardiovascular endurance.

Muscular strength is the amount of force a muscle can produce. Examples would be the bench press, leg press or bicep curl. The push up test is most often used to test muscular strength.

Muscular endurance is the ability of the muscles to perform continuous without fatiguing. Examples would be cycling, step machines and elliptical machines. The sit up test is most often used to test muscular endurance.

Flexibility is the ability of each joint to move through the available range of motion for a specific joint. Examples would be stretching individual muscles or the ability to perform certain functional movements such as the lunge. The sit and reach test is most often used to test flexibility.

Body composition is the amount of fat mass compared to lean muscle mass, bone and organs. This can be measured using underwater weighing, Skinfold readings, and bioelectrical impedance. Underwater weighing is considered the “gold standard” for body fat measurement, however because of the size and expense of the equipment needed very few places are set up to do this kind of measurement.

Why the need for physical fitness testing?

As stated earlier the 5 components of physical fitness represent how fit and healthy the body is as a whole. When you have the battery of tests performed you will receive information on the specific areas you made need to work in. A very specific goal oriented fitness program can be developed from the test battery.

If body composition is of (higher fat compared to muscle mass) there are many health related diseases and illnesses you have a higher chance of contracting. It is important to combine healthy eating habits with your exercise program.

If you scored low on the cardiovascular test you would have a higher chance of being at risk for heart related illnesses and would not do well with activities that require longer times to complete. You would participate in things such as long bike rides, swimming and jogging for extended periods of time to correct this component.

The next three tests can have results that are isolated to specific joints and muscles of the body or affect the body as a whole.

If you score low on the flexibility tests, you have a greater chance of decreased performance in daily living activities/sports and a higher risk of injury. You may also experience low back pain. It would be important to included flexibility training into your workout everyday.

If you scored low on the muscular endurance test you fatigue early into the exercise or activities of daily living. Many exercises that require high reps and low weight would be implemented into your training program.

If you scored low on the muscle strength test you do not have enough strength to perform well in sports, resistance training and activities of daily living. Your fitness program would have a progressive strength training component added that would allow you to become stronger with little chance of injury over time.

Fitness testing has its limitations – while it gives you a good idea of where your body is, it does not paint the entire picture. As stated earlier some of the above tests are only testing specific body parts. Other important factors such as balance and agility are not tested. It also requires the ability to perform the tests. It would be dangerous for someone who is in poor condition and does not exercise to participate in fitness testing.

Before deciding to undergo fitness testing, make sure you know why they are being done and determine that it is safe for you to participate.

 

There are some instances where travel agents can travel for free, but for the most part they do come out of their pocket. Below are three instances where travel agents can rack up extra savings and put money back into their pockets.

Get Paid on Retail or Sale Pricing

When I travel as an insider, I get paid when I book travel for myself (and of course I get paid when I do it for others). The price I pay could be the same as any one that is not part of the industry, the difference would be I get a check and you don’t! Commissions are already built-into the price of what you see online or what your travel agent quote you already has the commissions built-in. (they are never in addition to price quoted, if you are told extra fees need to be added to cover commission… run)

Travel at Net or Wholesale Pricing

Now, if I decide that I want to travel at a lower cost and forgo my commission, I still have to pay the net cost, I just would not get paid for the trip. You can get travel at great bargains if you travel this way!

But, I must add that various agencies may have ‘special’ discounted trips that agents can take for themselves or sell to their clients and STILL get a commission! I love these because your getting paid AND the rates can be even better than net rate PLUS you have a great deal you can offer to your clients. Only downside is that there may be a limit on how many can travel and restricted to specific dates.

Travel on the Industries Dime

What about those really dirt cheap trips? Yes, dirt cheap destinations do exist and are exclusive for travel agents and are typically known as FAM trips or Familiarization trips. These trips are more educational for travel agents and teach agents about the property or destination experience they are visiting.

Vendors invite agents on these ‘FAM’ trips so they can get more in-depth knowledge to share with their clientele. The goal is to promote to get more bookings for those properties or destinations. Prices for these trips are such a steal that they might as well be free!

Just to recap, travel agents pay for their trips in four ways:

1. Travel at retail pricing & get paid the already built-in commission

2. Travel at retail minus already built-in pricing (therefore no commissions are paid)

3. Travel at wholesale plus get a commission (vary per agency and limits dates & quantity)

4. Travel on a FAM trip – steeply discounted trips (exclusive to travel agents

It will typically describe our attitudes, interests and is a big part of our personal identities. In the media the term lifestyle is used a huge number of ways. From health to financial it has a varied meaning throughout many areas of our lives.

In the media the term was actually introduced in the 1950’s and at the time it was used to describe a certain style or art. Since its introduction we now all use the word to determine where we are in society and the lifestyle we choose to follow will ultimately lead us on our own separate and varied paths.

We are all looking for ways to improve our lives and we are constantly given tips and advice on how we may get healthier or how we can improve our fashion or style. With all of the different places offering advice, it can be confusing and conflicting. Some people may turn to magazines or friends and others will look for online information via blogs.

Looking to improve your lifestyle in any form can be a big decision and for a lot of people it will come down to wanting to change they way they look or eat. Choosing a healthier way of life has become a top priority for most people as we all seek out the best place for advice and to teach ourselves the skills we need to achieve our health goals.

Looking online at blogs for fashion advice and tips is often a great starting place, we have the chance to find out about a range of different subjects, often covered by extremely passionate people. For example if you decide you want to get fitter, you will be able to go online and find out about the best exercise plan for you, all of which will eventually help you improve your health and fitness levels.

Fashion is another place we often look to when we want to enhance our lifestyle. Clothes have the innate ability to make us feel special, confident and unique or individual. Many of us do not take the time to think about buying clothes that suit our personalities and finding inspiration and advice from an expert can be a liberating experience.

When you are able to walk down the street and feel confident and happy in what you are wearing, it can have a hugely positive effect and essentially has the power to enhance your lifestyle. Confidence will allow you to make other decisions in your life that may have seemed unachievable before. The expression ‘fashion is passion’ is very true for so many people and we are all spoilt for choice in finding clothes and shoes we want to wear. Fashion has the power to connect friends, join communities together and make us all feel happier and comfortable about who we are and how we express ourselves.

Fashion really does have the power to improve your lifestyle and finding someone or a place you can look to for advice and tips is now easier than ever. Searching online for that one person you can relate to and want to learn from is an exciting part of learning about your identity.

It is not clear how music influences the individual. Some experts insist that music and musicians influence young people. Other sources insist that certain individuals respond to particular types of music and musical expression. Either way, today’s youth can see how their favorite musicians dress and behave, both in public and in private, via the multiple media sources which are constantly monitoring the world’s celebrities. Young people can then elect to change their own appearance and behavior to reflect the musician and musical style that they most identify with.

Two separate, but related, theories explain how individuals relate to and express themselves through music. Social identity theory indicates that people “borrow” their identity from the society in which they live. The individual’s adopting of a group identity through music is a way for that person to conform to the ideals, goals, and norms of the society as a whole. The opposite of social identity theory says that some individuals elect to behave in a manner that is contrary to societal norms. These people prefer to adopt their own style and stand apart from everyone else. This is called personal identity theory. These theories are interrelated because, even though personal identity theory identifies the individual aspects of expression, the person is still identifying as a part of a sub-group.

Young people are more likely to subscribe to varying forms of identification through music; especially those forms that my not conform to the larger society. As young people move through the adolescent years and into young adulthood, they are more likely to explore and experiment with their own identity through music than older adults, who have likely settled into one genre that they identify with. Looking at music in this way makes it easier to see how it has always been, and remains, a socializing agent; a way for young people to explore their independence as they move away from the authority of their parents.

This perspective on music can hide the influence that music has on children. The music of the past century has played an important role in the lives of young adults, yet music may be having an expanding effect on individuals who are even younger. Remember that music has always been an important part of every society. Children are socialized through songs that are shared with them at many ages. Children’s songs can be as simple as songs that teach basic information, such as ABC’s and 123’s, and they can teach social skills and acceptable behavior (think Sesame Street and Barney). Still, children have access to the same music that young adults have access to; and sometimes this music is not age-appropriate. This phenomenon has ushered in the debates about whether or not exposure to certain musical influences is having a harmful effect on the nation’s youth.

Interestingly, one study has found that females are more likely to be influenced by music than males, although both genders find expression through music satisfying. This may be because females are typically socialized as members of a societal group and males are typically encouraged to be self-sufficient. The study’s authors believe that the socialization process makes females more susceptible to musical influences than males.

Communication is always one of the most important and vital strategic areas of an organization’s success. You can have the best or most innovative products or services, but if your internal and external communications are weak, then the demand for your products or services raises a personal flag of concern. When communicating the value of your products or services, you want to focus on how they will benefit your clients.

When planning your strategy for Integrated Marketing Communication or IMC, you want to have dialogue with your customers by inviting interaction through the coordinated efforts of content, timing and delivery of your products or services. By ensuring direction, clarity, consistency, timing and appearance of your messages, conveyed to your targeted audience, these factors will help avoid any confusion about the benefits of your brand, through the connection of instant product recognition.

When looking at your marketing mix, you’re examining price, distribution, advertising and promotion, along with customer service. Integrated marketing communication is part of that marketing mix included in your marketing plan. IMC strategies define your target audience, establishes objectives and budgets, analyzes any social, competitive, cultural or technological issues, and conducts research to evaluate the effectiveness of your promotional strategies.

If companies are ethically planning, communicating, and following industry guidelines, they will most likely earn the trust of their customers and target audience. There are five basic tools of integrated marketing communication:

1. Advertising:

This tool can get your messages to large audiences efficiently through such avenues as radio, TV, Magazines, Newspapers (ROP), Internet, Billboards and other mobile technological communication devices. This method can efficiently reach a large number of consumers, although the costs may be somewhat expensive.

2. Sales Promotion:

This tool is used through coupons, contests, samples, premiums, demonstrations, displays or incentives. It is used to accelerate short-term sales, by building brand awareness and encouraging repeat buying.

3. Public Relations:

This integrated marketing communications tool is initiated through public appearances, news/press releases or event sponsorships, to build trust and goodwill by presenting the product, company or person in a positive light.

4. Direct Marketing:

This tool will utilized email, mail, catalogs, encourage direct responses to radio and TV, in order to reach targeted audiences to increase sales and test new products and alternate marketing tactics.

5. Personal Selling:

Setting sales appointments and meetings, home parties, making presentations and any type of one-to-one communication, to reach your customers and strengthen your relationship with your clients, initiate this IMC tool.

Decisions linking the overall objectives and strategies during the marketing planning phases help to evaluate and fine-tune the specific activities of integrated marketing communication. Before selecting an IMC tool, marketing, product and brand managers must look at social, competitive, legal, regulatory, ethics, cultural and technological considerations. One thing you want to avoid when activating the tools of integrated marketing communication is reaching inappropriate audiences and causing controversy. That could be damaging when trying to build brand awareness and encourage consumer spending with your company. When marketing managers examine the beliefs, emotions and behavior of their targeted audience towards their brand, they can influence their beliefs to achieve product awareness, by attracting attention to their promotional campaigns.

Filipino music and art have both been influenced by the cultures that have migrated to this nation. The first type of music that developed in the Philippines was indigenous music brought here by native tribes that migrated from Taiwan. There are three basic groups of indigenous music styles: southern styles, northern styles and other styles. The southern style of music usually involves five different instruments including the kulintang, the agung, the gangdinagan, the dabakan and the babedil. The northern styles of indigenous music reflect Asian gong music. Their music usually features the unbossed gong called the Gangsa. In addition to the instruments used by southern and northern music styles, other instruments used in the Philippines include log drums, flutes, bamboo zithers and the Kudyapi.

Hispanic cultures from Spain and Mexico have greatly influenced the development of Filipino music. These cultures have introduced musical forms like the Harana the Kundiman and Rondalla. Most of these music forms developed as a result of the fusion between tribal music styles and traditional Spanish and Mexican music. Today the influence of Spain and Mexico is still present in modern Filipino music. Modern popular music in the Philippines still has a Hispanic flavor.

Filipino Art has its roots in indigenous traditions and colonial imports. Like most cultures, the Philippines have their own style of plastic arts like sculpture and painting. However, they also have their own style of movement arts like dancing. Some of the most notable artists from the Philippines include Fernando Amorsolo, David Cortes Medalla, Nunelucio Alvardao, Juan Luna, Felix Hidalgo and Rey Paz Contreras.

You may be wondering if the title of real estate consultant is a meaningful one, and if it indicates anything different from the same old licensed real estate brokers with a vested interest in the fate of a property. While it is true that anyone can call himself or herself a consultant, the term is not meaningless window dressing. For those who take their real estate consulting business seriously, it represents a different model, a different approach to real estate practice.

The first and most important difference is objectivity. Whereas a real estate broker typically is paid contingent on an outcome-in other words, they receive a commission-a real estate consultant is paid solely for their expertise. They have no stake in the outcome. Salespeople are paid only for getting a result-a sale. Real estate consultants are paid for their expert advice only, and by design have no stake in achieving a particular outcome to a particular transaction. This gives them the capacity to be more objective and inherently more trustworthy than a traditional real estate salesperson. Think about it-even the most honest salesperson will unconsciously try to steer you toward a sale. After all, that’s where their pay comes from-from selling! The consultant is paid the way other professional advisors or service professionals like CPAs are, with a retainer regardless of outcome.

Consulting can involve a variety of skills and areas of expertise. You can hire a consultant for legal advice, market research, or to locate possible properties to invest in, among other things. Since they are paid as much for their time if they advise you that there are no properties in an area worth investing in as if they advise you of dozens of viable properties, they have no stake in anything except giving you the best advice possible. After all, their future business depends on word-of-mouth endorsements from investors like you.

If you are looking for properties to invest in, a real estate consultant can tip you off to developer closeouts and bulk opportunities, equity partnerships, joint ventures, and possibly even some very unique and profitable turnkey investment opportunities. The consultant is selling information and expertise, and therefore can provide you with a layer of insulation between you and the people selling the properties. They can work out a lot of the details and business prospects of a property before you have to talk to a salesperson. Once you face the salesperson, you can approach the negotiation fully armed with an array of appropriate information, and thus avoid being bamboozled and negotiate from a position of strength.

If, on the other hand, you are selling properties, especially if you have a lot of properties to sell, a real estate consultant can help you create a strategy to sell the units before you get involved with actual salespeople, which can have many advantages. For example, you can sell a lot of properties in a relatively short time without creating the appearance of a bulk sale by having a real estate consultant distribute the properties among several different sellers.

 

A wedding photographer is not just any photographer who comes along to take some photographs; they should be able to connect in a friendly and confident manner, with the bride, groom, parents, grandparents and any children at the wedding and sometimes, the pet dog as well. The photographer should feel all the emotions and become a part of their day, by that I mean that they should understand the emotions of the people attending the wedding, after all, how else can the wedding photographer capture these emotions on camera, if they don’t feel and understand them.

The romance, excitement and the final realisation of months, maybe even years, of planning for this one day and it’s the wedding photographer’s job to capture these emotions in a realistic yet, beautiful way. The bride and groom will be nervous, the parents hoping everything runs as smoothly as they have planned for and the kids, trying not to look too bored with all the fuss around them. I often capture some great photographs of the kids at weddings. The photographs should reflect the events of the day in such a way that, looking back, when you’re an old married couple, it will seem like the wedding was only yesterday.

All the details need to be photographed, including the church or venue for the ceremony and of course, the reception. As a wedding photographer, I consider it a vital part of my work, to arrive early, get to know the layout of wedding venue, select the best positions and angles for the shots that I want to capture, during the ceremony and strive to produce incredible photos.

Unfortunately, there are still some people who will not allow the religious ceremony to be photographed which is another reason I like to arrive early, to give myself the opportunity to chat with the minister, priest or official who will be conducting the ceremony and if possible, gain a little compromise, in such cases. A good wedding photographer will be aware of all the areas to consider for every occasion. Your wedding will be unique and your wedding photographs should also be unique.

I chose to specialise in wedding photography, initially because I didn’t have a photography studio however, while I run a photography business, I also get so much personal enjoyment from photographing weddings, and I wouldn’t have it any other way.

My approach to wedding photography is very relaxed; I prefer the wedding photojournalism approach, as most top wedding photographers do. My wedding portfolio is full of photographs of relaxed couples enjoying their wedding day and spending time with friends and family not, the photographer. These photographs are far more enjoyable to look at and also help to capture the wedding’s events as they unfold, naturally.

In short, wedding photography is very much a specialised area and wedding photography should always be left to the professional. Weddings can’t be re-photographed in a photography studio. The photographer who chooses to photograph weddings, had better know exactly what he or she is doing and be able to get it right, every time. It’s a huge responsibility and requires a responsible wedding photographer.

In any Listing Agreement there is a point in time when the agency relationship ends.

A Listing Agreement, as it is widely known, is none other than a contract between the rightful titleholder of an interest in land (the ‘Principal’) and a duly licensed real estate firm (the ‘Agent’), whereby the firm stipulates and agrees to find a Buyer within a specified timeframe who is ready, willing and able to purchase the interest in land that is the subject matter of the contract while acting within the realm of the authority that the Principal confers onto the Agent, and wherein furthermore the titleholder stipulates and agrees to pay a commission should the licensee ever be successful in finding such Buyer.

As in all contracts, there is implied in a Listing Agreement an element which is commonly know at law as an ‘implied covenant of good faith and fair dealings’. This covenant is a general assumption of the law that the parties to the contract – in this case the titleholder and the licensed real estate firm – will deal fairly with each other and that they will not cause each other to suffer damages by either breaking their words or otherwise breach their respective and mutual contractual obligations, express and implied. A breach of this implied covenant gives rise to liability both in contract law and, depending on the circumstances, in tort as well.

Due to the particular nature of a Listing Agreement, the Courts have long since ruled that during the term of the agency relationship there is implied in the contract a second element that arises out of the many duties and responsibilities of the Agent towards the Principal: a duty of confidentiality, which obligates an Agent acting exclusively for a Seller or for a Buyer, or a Dual Agent acting for both parties under the provisions of a Limited Dual Agency Agreement, to keep confidential certain information provided by the Principal. Like for the implied covenant of good faith and fair dealings, a breach of this duty of confidentiality gives rise to liability both in contract law and, depending on the circumstances, in tort as well.

Pursuant to a recent decision of the Real Estate Council of British Columbia (http://www.recbc.ca/) , the regulatory body empowered with the mandate to protect the interest of the public in matters involving Real Estate, a question now arises as to whether or not the duty of confidentiality extends beyond the expiration or otherwise termination of the Listing Agreement.

In a recent case the Real Estate Council reprimanded two licensees and a real estate firm for breaching a continuing duty of confidentiality, which the Real Estate Council found was owing to the Seller of a property. In this case the subject property was listed for sale for over two years. During the term of the Listing Agreement the price of the property was reduced on two occasions. This notwithstanding, the property ultimately did not sell and the listing expired.

Following the expiration of the listing the Seller entered into three separate ‘fee agreements’ with the real estate firm. On all three occasions the Seller declined agency representation, and the firm was identified as ‘Buyer’s Agent’ in these fee agreements. A party commenced a lawsuit as against the Seller, which was related to the subject property.

The lawyer acting for the Plaintiff approached the real estate firm and requested that they provide Affidavits containing information about the listing of the property. This lawyer made it very clear that if the firm did not provide the Affidavits voluntarily, he would either subpoena the firm and the licensees as witnesses to give evidence before the Judge, or he would obtain a Court Order pursuant to the Rules Of Court compelling the firm to give such evidence. The real estate firm, believing there was no other choice in the matter, promptly complied by providing the requested Affidavits.

As a direct and proximate result, the Seller filed a complaint with the Real Estate Council maintaining that the information contained in the Affidavits was ‘confidential’ and that the firm had breached a duty of confidentiality owing to the Seller. As it turned out, the Affidavits were never used in the court proceedings.

The real estate brokerage, on the other hand, took the position that any duty of confidentiality arising from the agency relationship ended with the expiration of the Listing Agreement. The firm argued, moreover, that even if there was a duty of continuing confidentiality such duty would not preclude or otherwise limit the evidence that the real estate brokerage would be compelled to give under a subpoena or in a process under the Rules Of Court. And, finally, the realty company pointed out that there is no such thing as a realtor-client privilege, and that in the instant circumstances the Seller could not have prevented the firm from giving evidence in the lawsuit.

The Real Estate Council did not accept the line of defence and maintained that there exists a continuing duty of confidentiality, which extends after the expiration of the Listing Agreement. Council ruled that by providing the Affidavits both the brokerage and the two licensee had breached this duty.

The attorney-client privilege is a legal concept that protects communications between a client and the attorney and keeps those communications confidential. There are limitations to the attorney-client privilege, like for instance the fact that the privilege protects the confidential communication but not the underlying information. For instance, if a client has previously disclosed confidential information to a third party who is not an attorney, and then gives the same information to an attorney, the attorney-client privilege will still protect the communication to the attorney, but will not protect the information provided to the third party.

Because of this, an analogy can be drawn in the case of a realtor-client privilege during the existence of a Listing Agreement, whereby confidential information is disclosed to a third party such as a Real Estate Board for publication under the terms of a Multiple Listings Service agreement, but not before such information is disclosed to the real estate brokerage. In this instance the privilege theoretically would protect the confidential communication as well as the underlying information.

And as to whether or not the duty of confidentiality extends past the termination of a Listing Agreement is still a matter of open debate, again in the case of an attorney-client privilege there is ample legal authority to support the position that such privilege does in fact extend indefinitely, so that arguably an analogy can be inferred as well respecting the duration of the duty of confidentiality that the Agent owes the Seller, to the extent that such duty extends indefinitely.

This, in a synopsis, seems to be the position taken by the Real Estate Council of British Columbia in this matter.

Clearly, whether the duty of confidentiality that stems out of a Listing Agreement survives the termination of the contract is problematic to the Real Estate profession in terms of practical applications. If, for instance, a listing with Brokerage A expires and the Seller re-lists with Brokerage B, if there is a continuing duty of confidentiality on the part of Brokerage A, in the absence of express consent on the part of the Seller a Realtor of Brokerage A could not act as a Buyer’s Agent for the purchase of the Seller’s property, if this was re-listed by Brokerage B. All of which, therefore, would fly right in the face of all the rules of professional cooperation between real estate firms and their representatives. In fact, this process could potentially destabilize the entire foundation of the Multiple Listings Service system.

In the absence of specific guidelines, until this entire matter is clarified perhaps the best course of action for real estate firms and licensees when requested by a lawyer to provide information that is confidential, is to respond that the brokerage will seek to obtain the necessary consent from the client and, if that consent is not forthcoming, that the lawyer will have to take the necessary legal steps to compel the disclosure of such information.
